This student handbook provides the direction that informs and guides Kangaroo Training Institute Pty Ltd towards the provision of best practice in training development, management and service delivery. For Kangaroo Training Institute Pty Ltd, it will facilitate compliance with the standards regulated by the Australian Skills Quality Authority. For clients of Kangaroo Training Institute Pty Ltd, it will ensure that their investment in training provides the best possible training experience and outcomes.
Australian Skills Quality Authority (ASQA) is the national regulator for Australia’s vocational education and training sector. ASQA regulates courses and training providers according to the Standards for Registered Training Organisations 2015 (SNRs) to ensure nationally approved quality standards for training are met. The focus of these standards is the demonstration of preparedness of registered training organisations to deliver quality training and assessment services and focus on continuous improvement.
All programs offered by Kangaroo Training Institute Pty Ltd are aligned to the www.training.gov.au training package for quality assurance and best practice. Kangaroo Training Institute Pty Ltd recognises the importance and benefits of combining industry experience with tertiary education when striving to deliver programs of highest quality and relevance to the client.
The adult learning environment within the RTO, and any partnering organisations, encourages and supports the participation of people from diverse backgrounds. The RTO’s aim is for each student to have an equal opportunity to learn in a supportive environment.
Student Rights & Responsibilities
The RTO, and any partnering organisations, recognise that students have the right to:
Expect the RTO, and any partnering organisations, to provide training of a high quality that recognises and appreciates their individual learning styles and needs;
Have access to all the RTO’s, and any partnering organisations services regardless of educational background, gender, marital status, sexual preference, race, colour, pregnancy, national origin, ethnic or socio-economic background, physical or intellectual impairment, and religious or political affiliation;
Have their prior learning, acquired competencies, and experience appropriately recognised in determining their requirements for training and assessment;
Be advised of the learning outcomes and prescribed assessment tasks for the training program of their choice prior to its commencement;
Appeal for a review of the results of an assessment;
Expect to achieve the published learning outcomes from their training program, if they, in turn, devote the necessary time and diligence to it;
Learn from fully qualified, competent and diligent trainers who observe their responsibility to address students’ learning needs, assist them to achieve the course outcomes, and assess their students’ work fairly;
Learn in an appropriately appointed, safe and clean learning environment, free of all forms of harassment and discrimination;
Be treated with dignity and fairness;
Expect the RTO, and any partnering organisations, to be ethical and open in their dealings, their communications and their advertising;
Expect the RTO, and any partnering organisations, to observe their duty of care to them;
Efficient handling of administrative matters including the processing of fees, concessions, refunds etc;
Privacy and confidentiality, and secure storage of student records in accordance with the RTO’s, and any partnering organisations, policies, to the extent permitted by law.
Students are responsible for:
Understanding and accepting the enrolment conditions for the courses they undertake;
Providing accurate information about themselves at the time of enrolment, and to advise the RTO, and any partnering organisations, of any personal information changes, including to their address or phone numbers within seven days;
Paying of all fees and charges associated with their course;
Signing in and out when attending training;
Abiding by any dress code stipulated by the RTO, and any partnering organisations,;
Not cheating or plagiarising in course work / assessments submitted for assessment;
Recognising the rights of staff and other students to be treated with dignity and fairness, and behaving in an appropriate and acceptable manner towards them;
Regular and punctual attendance;
Ensuring they attend classes sober and drug free, and smoke in designated areas;
The security of their personal possessions while attending a course;
Promptly reporting all incidents of harassment or injury to the CEO;
Respecting the RTO’s, and any partnering organisations, property and observing policy guidelines and instructions for the use of equipment;
Seeking clarification of their rights and responsibilities when in doubt;
Asking for assistance and / or support when needed.
Access and Equity
Access and Equity policies are incorporated into operational procedures. The RTO, and any partnering organisations, prohibits discrimination towards any group or individuals in any form, inclusive of:
Race, colour, nationality, ethnic or religious background
Physical or intellectual or psychiatric disability
Homosexuality (male or female, actual or presumed)
The RTO, and any partnering organisations, encourages Students with diverse backgrounds and a genuine interest in expanding their knowledge and skill to apply for admission into all courses.
Programs are designed and wherever possible, facilities set up to enhance flexibility of delivery in order to maximise the opportunity for access and participation by disadvantaged people.
Language, literacy and numeracy
As we are in a partnership agreement with a Registered Training Organisation working in the field of Licencing for high risk work, it is a condition of licencing that students must be able to speak and understand English to undertake any of our courses. This is to ensure that workers understand workplace instructions and can complete the necessary workplace paperwork.
To test literacy & numeracy, students may be given an industry-appropriate test.
Students with learning difficulties in literacy or numeracy are given reasonable assistance from Kangaroo Training Institute Pty Ltd, additional time in examinations. In the written assessment the whole test can be conducted orally where there is a language or literacy issue.
However, because of the high risk nature of the industry, interpreters are not allowed to act on behalf of students.
If it is deemed that a student could possibly require more Literacy and/or Numeracy support, the student may be directed to a Specialist Language & Literacy provider. Any fees incurred are the responsibility of the student. For Child Services- 13 QGOV (13 74 68).For Adult Services- 1300 6 555 06
Students with English as a second language are given assistance such as being able to provide oral responses to some assessments and also they are given additional time in theory examinations. However, even if English is their second language it still needs to be at a reasonable enough standard to ensure that workers understand workplace instructions and that they are capable of completing the necessary workplace based paperwork.
Staff members and Instructors are required to observe, identify and immediately act when a student has problems with language, literacy, or numeracy
Student Classroom Behaviour Policy
As a Nationally Recognised Registered Training Organisation is required under the terms of the VET Quality Framework (VQF) and the Occupational Health and Safety Act, to deliver Nationally Recognised Training in a safe and secure environment that best enables a student to obtain the requisite competencies.
The purpose of this policy is to clearly define the standard of behaviour considered acceptable to best enable learning and development.
The Director is responsible for implementation of this policy and the Training Manager is responsible for the management of this policy and ensuring that all staff are fully trained in its operation.
WHAT IS AND IS NOT CONSIDERED APPROPRIATE BEHAVIOUR AND DRESS
inappropriate clothing includes: thongs, ripped or torn clothing.
no unnecessary exposed flesh.
no offensive prints or words.
inappropriate language means: no swearing or abusive language.
mobile phones: no mobile phone use during class times or recording of content.
eating: no eating in the classroom.
no playing games on mobile devices during class times
lateness returning to class from breaks is unacceptable
Kangaroo Training Academy has the expectation of respectful behaviour to all other students, trainers and other individuals jumping, standing on or putting shoes on furniture is not permitted
RPL (Recognition of Prior Learning)
It is our intent to clearly define the process in which claims for Recognition of Prior Learning (RPL) and Recognition of Current Competencies (RCC) will be substantiated or negated.
In all instances whereby a Learner makes a claim for Recognition of Prior Learning (RPL) and Recognition of Current Competencies (RCC), it will be the designated trainer for the qualification to acknowledge the claim and assist the applicant with the application for Recognition of Prior Learning (RPL) and Recognition of Current Competencies (RCC), using the appropriate qualification RPL Kit.
All applications for RPL will be responded to within 15 working days of the receipt of the written application.
When a trainer receives an application for Recognition of Prior Learning (RPL) or Recognition of Current Competencies (RCC) the trainer is to:
Advise Learner of the cost involved;
Assist Learner with completion of application for RPL/RCC;
Advise Learner of evidence to be presented, including certificates, statements of attainment, references and copies of any work done;
Collect copy of all evidence for learner records;
Assist Learner with the relevant RPL Kit for the qualification;
Once all evidence has been submitted, Trainer is to review all evidence and determine the outcome and advise which subjects are required to be undertaken for issuance of the qualification if applicable;
Where actual documented evidence is not available, the trainer is to arrange for the applicant to demonstrate through practical demonstration and/or Oral questioning their knowledge and skills on the matter subject to verify their claim for RPL;
Once RPL is awarded store completed RPL Kit in the learners file as the required evidence.
Learners who wish to be credited units of a qualification through RPL/RCC are to:
Submit an application a minimum of 15 days prior to the commencement of the course;
Provide all evidence they wish to use to support their application;
Complete all steps in the appropriate RPL Kit for the qualification; and
Pay the fees
All trainers and assessors employed or contracted by Kangaroo Training Institute Pty Ltd have demonstrated significant industry experience in addition to obtaining tertiary qualifications, allowing them to provide a professional, well rounded learning environment for participants. Staff are equipped with the skills to ensure their teaching methods are suitable for all participants, utilising simple language where appropriate to communicate information most effectively. Kangaroo Training Institute Pty Ltd strictly adheres to the SNR to continue delivering training services of the highest quality to their clients.
The CEO recognises that opportunities for improvement arise in every aspect of business and has developed an organisational culture within Kangaroo Training Institute Pty Ltd to capitalise on these opportunities for improved practice. Kangaroo Training Institute Pty Ltd supplies feedback forms to all students at the end of each program, as participant feedback has been identified as an important and valuable factor in monitoring and developing business practices and quality training, ensuring the ever-changing needs and expectations of clients are being met. The CEO also welcomes feedback from other improvement opportunities such as risk assessment, student suggestions, complaints and appeals, validation sessions and audit reports.
As a student with Kangaroo Training Institute Pty Ltd your feedback is critical to our continuous improvement policy. Along with the formal feedback mentioned earlier, students are encouraged to give feedback throughout their enrolment.
In order to encourage and achieve continuous improvement based on the collection of the above mentioned data, Kangaroo Training Institute Pty Ltd has developed a best practice register which will include a written record of all improvement strategies.
Registered training organisations are subject to legislation pertaining to training and assessment, as well as business practice. Kangaroo Training Institute Pty Ltd will comply with relevant Commonwealth, State or Territory legislation and regulatory requirements relevant to its intended scope of registration.
Kangaroo Training Institute Pty Ltd will also inform all staff and clients of the legislative and regulatory requirements that affect their duties or participation in vocational education and training.
Kangaroo Training Institute Pty Ltd recognises that compliance with legislative requirements underpins the effective implementation of its operations and ensures accountability and transparency of activities of both management and staff.
Complying with Legislation
Staff will be advised at induction and kept up-to-date with changes to legislation through written correspondence. Policies and procedures and associated tools and templates will be updated to reflect updates to legislation. Any training that is required will be organised in a professional and timely manner.
The purpose of this policy is to clearly define the methods in which assessment services will be delivered.
PRINCIPLES OF ASSESSMENT
The assessment principles of validity, reliability, fairness and sufficiency will be met through the delivery of assessment in real time and as a combination of Written Assignments, Oral Assignments, Practical Assessments, Written and Summative Assessments as each student undertakes the particular unit of study.
The competency standards as set in the relevant training package, shall be the benchmarks for assessment
On-the-job assessment requirements will be met through consultation with the student and employer to ensure all necessary equipment and time is allocated for thorough assessment to be made.
Trainers are responsible for ensuring that assessments are conducted practically and ethically and that competency is confirmed and evidence is relevant and available. Students are responsible for ensuring that they have the evidence to support their application for competency in a unit of study.
The assessment process will be managed through the timely and accurate auditing of assessment documentation, observation of assessment practices and auditing of the assessment process and documentation by the Industry Validation and Moderation groups.
All assessments conducted by us will:
Comply with the assessment guidelines defined in the relevant nationally endorsed training package. In the case of our qualifications we will ensure that the competency assessment is determined by a vocationally competent assessor who holds the TAE40110 Certificate IV in Training and Assessment or higher qualification.
All of our assessments within our RTO will lead to the issuing of a statement of attainment or to the issuing of a qualification under the AQF where a person is assessed as competent against the National Endorsed units of competency in the applicable training package.
All of our Assessments will be:
Valid– Assessment methods will be valid, that is, they will assess what they claim to assess,
Reliable– Assessment procedures must be reliable, that is, they must result in consistent interpretation of evidence from the learner and from context to context,
Fair– Assessment procedures will be fair, so as not disadvantage any learners. Assessment procedures will:
be equitable, culturally and linguistically appropriate,
involve procedures in which criteria for judging performance are made clear to all participants,
employ a participatory approach,
provide for participants to undertake assessments at appropriate times and where required in appropriate locations.
Flexible– Assessment procedures will be flexible, that is , they should involve a variety of methods that depend on the circumstances surrounding the assessment,
We will achieve this through:
careful design of the assessments,
validation and moderation of the assessment materials conducted in our annual review,
an understanding of the definition and practical application of the above definitions.
All our assessments will provide for applicants to be informed of the context and purpose of the assessment and the assessment process.
This will include information regarding assessment methods, alternative assessment methods if required to accommodate special needs or circumstances, information will also be included at the start of each unit or course as to the assessment processes, number of assessments, types of assessment and the individual weighting of each assessment.
Our assessments and assessment methods will ensure that we:
focus on the application of the skill and knowledge as required in the workplace, including:
Task skills (actually doing the job)
Task management skills (managing the job)
Contingency management skills (what happens if something goes wrong)
Job Role environments skills (managing your job and its interaction with others around you)
We will ensure that we assess you in sufficient detail to ensure that we can determine that you have attained competency.
Staff are available to discuss and provide limited professional advice as to the outcomes of the assessment process and guidance on future options.
All assessment tasks must consider any language and literacy issues, cultural issues or any other individual needs related to the assessment.

ASSESSMENT RE-SIT PROCEDURE
Stage 1: Student undertakes in-class assessment: Students will be notified within 7 days of undertaking an assessment of their performance. If a student does not attend the in-class assessment, they should notify their trainer as to why they did not attend and if due to illness a medical certificate must be produced. If the assessment is a practical or no evidence is provided, administrative fee of $50 will be charged for re-sitting the assessment.
Stage 2: Student considered Not Competent in FIRST assessment: Students who are considered to be Not Competent are to be provided with information identifying the areas in which they failed to achieve competency. Students will then have the opportunity to repeat the assessment task within 7 days of notification.
Stage 3: Student considered Not Competent in FIRST re-sits (Second Attempt) If the student is again considered Not Competent they will be provided with information identifying the areas in which they failed to achieve competency. The student must then participate in a new assessment task within 7 days of notification; no fee will be charged for the assessment task.
Stage 4: Student considered Not Competent in SECOND re-sits (Third Attempt) If the student is still unable to demonstrate competency in the 3 rd attempt, then the student will be advised to RE-ENROL the unit of competency. NYC will then determine the time at which the unit will be available for the delivery. The student will be charged a re-enrolment fee of $295 per unit to complete the unit successfully to the competency level.
Students not achieving competency for the units in the course, will have the opportunity to be re-assessed on an individual basis by mutual arrangement.
This may be arranged prior to course completion to allow for students to graduate with other class participants
Course Conduct Procedure
As a Nationally Recognised Registered Training Organisation is required under the terms of the VET Quality Framework (VQF) and the Standards of the National Vet Regulator Act, 2011, to have a recognised procedure to identify the way in which its courses are managed.
The purpose of this procedure is to clearly define the process in which courses will be conducted and managed.
Each shall commence on the date as per the schedule of training and with a minimum of 10 participants for any course.
On receipt of the enrolment forms the Administration Assistant shall prepare the student files and advise the Training Manager and the Nominated Trainer of the number of participants. The Trainer shall then prepare sufficient Learner Guides and ensure all training resources are prepared and the training room has been set up as per the plan.
COMMENCEMENT OF COURSE
On the first day of the course, the trainer is to ensure participants have been inducted into the policies and procedures, including expected behaviours, pertinent to training and to ensure that all relevant course paperwork, including applications for Recognition of Prior Learning (RPL)/Recognition of Current Competency (RCC) has been submitted.
ONGOING COURSE MANAGEMENT
It is the Trainers responsibility to ensure that each course is conducted along the program schedule and that each student maintains the integrity of their training record book and the attendance sheet.
Trainers must also provide timely reporting of competencies to the Administration Assistant for updating of student files and reporting in SMART.
Any student missing 1 day from the course is to be met by the Trainer with a view to arranging a catch up day to complete the subjects missed on the given day. Any student missing 2 days or more, of any course is to be offered a place on the next course to complete the missing days.
Any student presenting barriers are to be advised to the Training Manager, with recommendation where appropriate, outside assistance to be brought in.
END OF COURSE
At the conclusion of the course, the Trainer is to ensure that all records of competency have been passed to the Administration Assistant for updating of SMART and that such copies are also recorded in the Participants File. The Trainer is also required to submit a report to the Training Manager, outlining the percentage rate of completion, the number of participants to, any changes desired to the program schedule and to the resources utilised. This report should also outline any additional resources required or desired and reasons for request.
The Training Manager will arrange for each student on the completing course to receive a quality questionnaire 28 days after the course has completed.
Initial Skill Assessment Policy & Procedure
We are required to ensure each person enrolling in Nationally Recognised Training (NRT) is able to meet the requirements of the training package, so that they may be awarded a result of competent and complete the qualification.
This requirement means we are also required to ensure each person enrolling is able to meet the demands of the qualification in relation to the Volume of Learning as described in the Australian Qualifications Framework (AQF) for each qualification on scope.
It is our intent to clearly define the initial skills process to ensure each learner is able to meet the requirements of the Training Package and Volume of Learning of their preferred course.
Prior to the acceptance of an enrolment.
To assist with the identification of potential language, literacy or numeracy barriers and non-vocational barriers to learning, an initial skills assessment shall be conducted with each applicant, at a time shortly after the application for enrolment has been received. PROCEDURE
Upon receipt of a valid application for enrolment
After receiving an application for enrolment, the designated trainer for the qualification will arrange a time with the applicant so that we can conduct an initial skills assessment. This may be done by telephone, video call or skype.
The initial skills assessment shall be conducted in a manner which allows the applicant to demonstrate they have:
An understanding of the industry sector they wish to be trained in;
Has some knowledge about the industry they are seeking to gain employment ;
Has an opportunity to discretely disclose any non-vocational and vocational barriers to study; and
Is able to discretely disclose the types of support they have experienced before, if applicable.
Prior to the commencement of the initial skills assessment the trainer is to outline:
The requirements of the training package;
Disclose the volume of learning, including the structured and non-structured training hours; and
The available supports available to the applicant should their enrolment be accepted.
Legal and Regulatory
As a Registered Training Organisation (RTO) Kangaroo Training Institute Pty Ltd is governed by ASQA (Australian Skills Quality Authority) and is required to provide the VET (Vocational Education and Training) regulator and other Commonwealth and or state and territory regulatory departments with regards to students and training activity data. This includes personal information collected by the kangaroo Training Institute Pty Ltd on the enrolment form for AVETMISS Data reporting to the National Centre for Vocational Education Research (NCVER) and Unique Student Identifier (USI) to be collected and handled in accordance with the Student Identifiers Act 2014 (Cth) and the Student Identifiers Regulation 2014 (Cth) as per the Commonwealth and Federal legislation.
Collection, Use and disclosure of your data
The use of your data will be in accordance with the Privacy Act 1988 which includes thirteen Australian Privacy Principles (APPs) as applicable, The data collected, stored, used and disclosed will be for a range of VET related purposes which include but are not limited to administration, monitoring, audit, education related, research purpose and to meet our reporting and legislative requirements to all the above mentioned regulatory bodies (ASQA, NCVER, USI).
You may be contacted to participate in a survey conducted by NCVER or a state or territory department-endorsed project, audit or review relating to your training. This provides valuable feedback on the delivery of VET programs.
Consequences of not providing your information
Failure to provide your personal information may mean that it is not possible for you to enrol in VET. Failure to provide USI and related information for USI verification purposes can prevent us from issuing you with a nationally recognised VET qualification or statement of attainment when you complete your course. Failure to provide us with USI search permission will prevent us from locating your USI which needs to be verified.
Access, correction and complaints

The assessment shall be conducted using the initial skills assessment form and with the applicants responses captured as accurately as possible, so that the evidence it contains is able to adequately guide the decision to progress the application to enrol to a completed enrolment and we can adequately prepare any support services or alternative training and assessment tools and resources.
The decision to progress the application to full enrolment, shall be guided using the assessment principles of: Fairness – The individual learner’s needs are considered in the assessment process. Where appropriate, reasonable adjustments are applied by the RTO to take into account the individual learner’s needs
Flexibility – Assessment is flexible to the individual learner by reflecting their needs, recognising competencies held and drawing from a range of assessment methods and contexts.
Validity – Any assessment decision is justified and based on the evidence of performance of the individual learner. The Assessor must be assured that the learner has the skills, knowledge and attributes as described in the Unit of Competency.
Reliability – Evidence presented for assessment in consistently interpreted and results are comparable irrespective of the Assessor conducting the assessment.

Cancellation, Change and Refund Policy
Cancellation and change fees are addressed according to the notice given by the person making the request:
Cancellation requested 15 or more days prior to the commencement of the course: Full amount refunded or held in credit for future use.
Change of date requested 15 or more days prior to the commencement of the course: No change fee.
Cancellation requested 7 to 15 days prior to the commencement of the course: 50% refunded.
Change of date requested 7 to 15 days prior to commencement of the course: We retain your original payment and charge a $75 change fee.
Cancellation prior 7 days to course, no show on the day, arrive too late, withdrawal during the course: All monies forfeited.
Change of date requested day prior to course commencement: We retain your original payment and charge a $100 change fee.
High Risk Online Courses (RIIWHS204E- Work Safely at Heights, RIIWHS202E- Enter and work in confined spaces and MSMWHS217- Gas Test Atmospheres) are 100% refund prior to starting the course. After starting the course and completed one or more assessment 50% only refunded.
Where a refund is due to a candidate, the applicable refund amount will be provided within thirty days.
From time to time, deposits may be required to secure a place on an upcoming course. These deposits are non-refundable.
Arriving late to a course affects the learning outcomes of all students. Kangaroo Training Institute Pty Ltd reserves the right to refuse entry to candidates who arrive late to a course.
Kangaroo Training Institute Pty Ltd reserves the right to cancel, postpone or re-schedule courses due to low enrolments or unforeseen circumstances. Should this occur a full refund and/or an opportunity to reschedule (without penalty) will be offered.
Kangaroo Training Institute Pty Ltd reserves the right to change course fees, dates, content, trainers or method of presentation at its discretion.
Kangaroo Training Institute Pty Ltd take responsibility and follow processes to ensure our training and assessment practices comply with the National Vocational Education and Training Act and Training Regulator Act 2011.

e-Learning Course-Specific Terms and Conditions
Each Kangaroo Training Institute Pty Ltd-Learning Course has a variety of Terms and Conditions which must be acknowledged and accepted prior to enrolment. These are provided to the candidate in writing at time of online booking, or discussed verbally in the case of a phone booking. These Terms and Conditions are in addition to all following Terms and Conditions which apply to all e-Learning courses.
e-Learning Course-Specific Terms (Maximum Time frame of Enrolment)
Each enrolment term commences at the the time of purchase at which point the participant will be notified of their username and password. Username and password notification will be via email to the address provided by the participant during the enrolment process when payment is received by Kangaroo Training Institute Pty Ltd. Under NO circumstances whatsoever may any registered user share or distribute their username or password to any third party. Any breach of this term will result in the immediate suspension of the account.
Enrolment terms for each course are provided at time of enrolment. Upon purchase of the selected course, each participant is provided with the expected course time frame and enrolment term. Unless advised differently at time of enrolment, Kangaroo Training Institute Pty Ltd standard enrolment term is 12 months. If you have not completed your training within the enrolment term, your enrolment will be withdrawn and your account disabled.
During the enrolment term, support will be provided during Kangaroo Training Institute Pty Ltd’s business hours ( 7:00 am – 5:00 pm AEST ). Support services are dependent upon on the type of course into which the participant has enrolled. Support services specific to each course are detailed in the relevant course guide/s. Turnaround times for marking
Applicability: This section relates to all e-Learning courses which require participants to submit assessment items for marking.
Upon successful enrolment into your course, you will be notified of your relevant trainer/s and/or assessor/s. Kangaroo Training Institute Pty Ltd will, upon receiving submission of an assessable item from you, endeavour to mark, and return, any piece of assessment within three (3) business days. Please be advised that larger pieces of assessment may take longer. If you have not received a response to your submission within twenty (20) business days, please contact Kangaroo Training Institute Pty Ltd to discuss.
Blended Courses – e-Learning and Face-To-Face
Applicability: This section relates to all e-Learning courses which require the completion of online training and assessment prior to assigned face-to-face training day/s.
Upon selection of your course, it is the responsibility of the learner to ensure they are aware of the due dates of the required assessment. Achieving a competent result for online assessment components prior to attending face-to-face training components is mandatory. Where a learner has not reached a competent result prior to attending face-to-face training, the learner will not be permitted to participate. In this case, the course fee is forfeited and a re booking fee will apply.
Extensions (to assessment time frames or enrolment terms) can only be granted due to compassionate or compelling circumstances that are generally those beyond the control of the participant and which have an impact upon the participant’s course progress or well being.
A participant may withdraw from an e-Learning course at any time. No refund will be issued after login to the e-Learning system.
You understand that all information, data, text, sound, photographs, graphics, messages or other materials (collectively: ‘content’), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such content originated.
You own the rights to your own content that you post to during your enrolment. However, as a condition of your enrolment, you hereby grant to us the perpetual, non-exclusive, transferable, royalty free licence to edit, modify, copy, publish, distribute, and otherwise use any content that you post.
You shall not upload to, or distribute or otherwise publish to your e-Learning course any content that:
contains viruses or other contaminating or destructive features
infringes any copyright, trademark, patent, trade secret or violates any right of privacy or publicity
contains material not relevant or otherwise inappropriate to the subject matter of a discussion board
otherwise violates any applicable law
Intellectual Property and Copyright
You acknowledge that the course you enrolled into contains content that is protected by copyright, trademark or our other proprietary rights. In addition, the course contains information, software and other content provided by third parties that is protected by copyright, trademark or other proprietary rights. We hereby grant you a non-exclusive, non-transferable licence to use the content, provided that you:
Only utilise the content for your own personal, non-commercial use
Do not modify, publish, transmit, reproduce, create derivative works from, distribute, or in any way exploit any of the content provided to you.
Minimum System Requirements
Participants are responsible for their own computer/device technology and Internet service. The technology standard required is described during the enrolment process for each e-Learning course provided.
Kangaroo Training Institute Pty Ltd is not responsible for any problems caused to or by your equipment, including any virus or related problems with your use of the Kangaroo Training Institute Pty Ltd e-Learning system.
You are responsible for all connection, access or data fees, and for installing, maintaining, and operating your own equipment. Kangaroo Training Institute Pty Ltd makes no warranties or interpretations that the website(s) contents and course information will meet your requirements.
Kangaroo Training Institute Pty Ltd is, as are all other businesses and corporations registered within Australia, bound by Australian Consumer Law, which outlines the rights of a consumer to receive a refund on either a product or service. Whilst Kangaroo Training Institute Pty Ltd will issue refunds in accordance with Australian Consumer Law, however, please note that refunds will not be provided where you have:
changed your mind;
found it cheaper somewhere else;
decided you did not like the purchase; or,
have no use for it.
Refunds will only be provided by Kangaroo Training Institute Pty Ltd where:
A person has been unable to complete their e-Learning course due to the unavailability of Kangaroo Training Institute Pty Ltd e-Learning services;
Refunds will not be granted, for example, where a person’s personal internet connection becomes unavailable, personal IT hardware is unable to meet the minimum requirements, or corporate internet access blocks access to the Kangaroo Training Institute Pty Ltd e-Learning services.
Breaching any of these terms and conditions may trigger a terminating event. The outcome of a terminating event may include any or all of the following (depending on the circumstances):
A formal warning
Cancellation of enrolment without refund
Whether a breach is triggers a terminating event is at the discretion of Kangaroo Training Institute Pty Ltd management.
1 If the Customer/ Student
(a) Fails to pay for any Goods, Course fee or services on the due date; or
(b) Otherwise breached this agreement and failed to rectify such breach within seven day’s notice; or
(c) Cancel delivery of Goods, Course or services; or
(d) Commits an act of bankruptcy or allows a trustee in bankruptcy or receiver and manager to be appointed to the Customer/Studnet or any of its property; or
(e) Allow a judgment or order to be enforced or become enforceable against the Customer’s/student's property; or
(f) Permits proceedings to be commenced to wind the Customer up or controller, receiver, administrator, liquidator or similar officers appointed to the Customer/Studnet in respect of any part of its property;
then the Company may enter upon the Customer’s/Student's premises (doing all that is necessary to gain access) where Goods supplied under this contract are situated at any time and re-take possession of any or all of the Goods the Company has supplied to the Customer and:
(i) Resell the Goods concerned;
(ii) Terminate the agreement; and
(iii) Sue for any monies owing.
1.2 The Customer/ student will be in default if the Customer/Student does not pay any monies payable when called upon so to do the Customer/Student and the Guarantor(s) jointly and severally acknowledge and agree that the Company is authorised to contact a credit reporting agency throughout the term of the Agreement to obtain a report about the creditworthiness of either the Customer/Studnet or the Guarantor(s) or both.
1.3 The Customer/Studnet and the Guarantor(s) jointly and severally authorise the Company to engage in the exchange of information with a credit reporting agency or with other such parties as are necessary to give effect to the contract and to the ongoing relationship between the parties hereto.
1.4 The Company reserves the right to report a Customer's/Studnet's delinquent account to a credit reporting agency should payment remain outstanding for more than 60 days. In addition the Company may refer the outstanding account for debt collection or issue legal proceedings to recover any outstanding invoices. Should an account be referred for debt collection the Customer acknowledges and agrees to pay debt collection charges to be calculated at not less than 20% plus GST and will be incurred on the day the Company refers the matter to their nominated debt collection agency. The Customer shall also be liable for interest and all legal recovery costs associated with such action on a solicitor and own Customer/Studnet or indemnity cost basis.

As a Nationally Recognised Registered Training Organisation is required under the terms of the VET Quality Framework (VQF) and the Standards of the National Vet Regulator Act, 2011, to have an established policy and procedures for the management of the Unique Student Identifier.
The purpose of this policy is to clearly define the process in which we will manage USI requirements.
We will implement the national requirements for the Unique Student (USI) from date of registration as directed by ASQA in relation to the delivery of Units of Competency. This RTO will adhere to all legislative requirements under the USI legislation and regulations (2014) and any amendments; this includes all Privacy requirements.

All students will be asked for their USI on enrolment.
Pre-existing USI will be verified on enrolment.
It is expected most students will be able to manage their own USI through the USI website, however, where a student is unable to obtain their own USI the RTO will assist in the process.
USI will be verified at enrolment
USI must have been verified before issuing a qualification.
The privacy of USI will be protected within all administrative tasks.
Students will be informed as to when their new qualifications will appear on their USI record.
A staff member will be designated to administer the USI system
Staff will be trained in all aspects of USI administration and access and all computer security checked to ensure all unauthorised access is blocked.
Information regarding obtaining a USI will be published on the website and in the Student Handbook.
If you do not already have a Unique Student Identifier (USI) and you want us to apply for a USI to the Student Identifiers Registrar (Registrar) on your behalf, we will provide to the Registrar the following items of personal information about you:
your name, including first or given name(s), middle name(s) and surname or family name as they appear in an identification document;
your date of birth, as it appears, if shown, in the chosen document of identity;
your city or town of birth;
your country of birth;
your gender; and
your contact details.
When we apply for a USI on your behalf the Registrar will verify your identity. The Registrar will do so through the Document Verification Service ( DVS ) managed by the Attorney-General’s Department which is built into the USI online application process if you have documents such as a Medicare card, Birth Certificate, Driver Licence, Australian Passport, citizenship document, Certificate of registration by descent, Immigrated or Australian entry visa.
If you do not have a document suitable for the DVS and we are authorised to do so by the Registrar we may be able to verify your identity by other means. If you do not have any of the identity documents mentioned above, and we are not authorised by the Registrar to verify your identity by other means, we cannot apply for a USI on your behalf and you should contact the Student Identifiers Registrar.
In accordance with section 11 of the (Commonwealth) Student Identifiers Act 2014 (SI Act), we will securely destroy personal information which we collect from you solely for the purpose of applying for a USI on your behalf as soon as practicable after the USI application has been made or the information is no longer needed for that purpose, unless we are required by or under any law to retain it.
The personal information about you that we provide to the Registrar, including your identity information, is protected by the Commonwealth Privacy Act 1988 (Privacy Act). The collection, use and disclosure of your USI are protected by the SI Act.
If you ask us to make an application for a student identifier on your behalf, we will have to declare that we have complied with certain terms and conditions to be able to access the online student identifier portal and submit this application, including a declaration that we have given you the following privacy notice:
You are advised and agree that you understand and consent that the personal information you provide to us in connection with your application for a USI:
is collected by the Registrar for the purposes of:
applying for, verifying and giving a USI;
resolving problems with a USI; and
creating authenticated vocational education and training (VET) transcripts;
may be disclosed to:
Commonwealth and State/Territory government departments and agencies and statutory bodies performing functions relating to VET for:
the purposes of administering and auditing Vocational Education and Training (VET), VET providers and VET programs;
education related policy and research purposes; and
to assist in determining eligibility for training subsidies;
VET Regulators to enable them to perform their VET regulatory functions;
VET Admission Bodies for the purposes of administering VET and VET programs;
Current and former Registered Training Organisations to enable them to deliver VET courses to the individual, meet their reporting obligations under the VET standards and government contracts and assist in determining eligibility for training subsidies;
Schools for the purposes of delivering VET courses to the individual and reporting on these courses;
The National Centre for Vocational Education Research for the purpose of creating authenticated VET transcripts, resolving problems with USIs and for the collection, preparation and auditing of national VET statistics;
Researchers for education and training related research purposes;
Any other person or agency that may be authorised or required by law to access the information;
Any entity contractually engaged by the Student Identifiers Registrar to assist in the performance of his or her functions in the administration of the USI system; and
will not otherwise be disclosed without your consent unless authorised or required by or under law.
You may also make a complaint to the Information Commissioner about an interference with privacy pursuant to the Privacy Act, which includes the following:
misuse or interference of or unauthorised collection, use, access, modification or disclosure of USIs; and
a failure by Us to destroy personal information collected by you only for the purpose of applying for a USI on your behalf.
